SMS Communication Terms

Overview
IvoryStack is a software platform owned and operated by Regal Dental Alliance that provides participating dental practices (each, a "Practice") with patient-engagement tools, including appointment confirmation messages, appointment reminders, and short personalized video messages from the patient’s provider. These tools may deliver text messages (SMS) to patients on the Practice’s behalf. The platform is developed and maintained by Genesis 37 Labs LLC under contract with Regal Dental Alliance.
These SMS Communication Terms describe how a patient opts in to receive these messages, what types of messages they will receive, how to opt out, and how their information is handled.
Development and testing
Two separate SMS-sending accounts are associated with IvoryStack:
- A production messaging account, operated by Regal Dental Alliance, that delivers messages to patients of participating Practices as described throughout the remainder of this document.
- A development and quality-assurance messaging account, operated by Genesis 37 Labs LLC, that is used solely for internal testing of the platform during development. This account sends messages only to a fixed allow-list of phone numbers belonging to Genesis 37 Labs employees, contractors, and Regal Dental Alliance staff. All recipients have provided consent for receiving test messages as a condition of their employment or engagement, and all recipients are registered as Verified Caller IDs with the messaging provider. No consumer or patient messages are sent through this development account.
The remainder of this document describes the patient-facing production messaging flow.
How patients opt in
Patients opt in to SMS communication at the time they book or confirm an appointment with a participating Practice. The Practice presents the patient with an intake form (online or in-office) that includes the following checkbox, which the patient must affirmatively check to consent:
☐ I agree to receive appointment-related text messages from my dental practice and IvoryStack, including appointment confirmations, reminders, and short video messages from my provider. Standard message and data rates may apply. Message frequency: 1–4 messages per appointment. I understand I can opt out at any time by replying STOP.
Patients may decline this checkbox without affecting their ability to book or attend an appointment.
Types of messages patients receive
Opted-in patients may receive:
- A welcome message when a new appointment is booked, including a short video message from the provider.
- An appointment reminder the morning of the appointment, including directions, parking instructions, and any intake paperwork the Practice requires.
- A post-visit follow-up (when applicable) confirming the visit and providing aftercare instructions.
Patients will not receive marketing, promotional, or third-party content via SMS through IvoryStack. Communication is limited to the purposes above and is initiated by appointment events in the Practice’s scheduling system.
Message frequency
Typical patients receive 1–4 messages per appointment. Patients who have multiple upcoming appointments may receive more. Patients are never enrolled in recurring messaging campaigns; every message is tied to a specific appointment event.
How patients opt out
Patients may opt out of SMS communication at any time by:
- Replying STOP to any IvoryStack message. The opt-out is processed immediately and applies across all message types.
- Replying HELP for assistance, which returns the Practice’s contact phone number.
- Contacting the Practice directly to update their communication preferences.
To resume messages after opting out, patients can reply START to the same number or re-consent during their next appointment booking.
Costs
IvoryStack does not charge patients to send or receive SMS. Standard message and data rates from the patient’s mobile carrier may apply.
Privacy and HIPAA
SMS communication is governed by IvoryStack’s Privacy Policy and applicable laws, including the Health Insurance Portability and Accountability Act (HIPAA). Patient phone numbers and message content are:
- Stored encrypted at rest
- Transmitted only to the Practice that initiated the message and to our SMS delivery partner (Twilio Inc., subject to a Business Associate Agreement)
- Never sold, rented, or shared with third parties for marketing
- Retained only as long as required to fulfill the appointment-related purpose and any applicable record-keeping obligation
IvoryStack does not transmit detailed health information via SMS. Messages contain only the patient’s first name, appointment time and location, provider name, and a link to a personalized video hosted on IvoryStack infrastructure.
